Infinite Performance – Terms & Conditions

• 7‑day cooling‑off period applies to all new memberships (as required by WA Fitness Code).
• 24‑hour cancellation required for in‑person PT sessions; missed or late cancellations are forfeited (no refund).
• 8‑Week Challenge: non‑refundable once commenced.
• Online coaching: requires one (1) month’s written cancellation notice.
Welcome to Infinite Performance! These Terms & Conditions govern your participation in services provided by David McNamara (sole trader, trading as Infinite Performance) operating at Goodlife Health & Fitness and online via the PT Distinction platform. By enrolling, paying for, or participating in any of our services, you confirm you have read, understood, and agreed to the following Terms & Conditions.
1. Services & Payments
Services include: one‑to‑one personal training at Goodlife Health & Fitness, group fitness sessions, the 8‑Week Sculpt Challenge, and online coaching via the PT Distinction app.
All fees must be paid in full prior to commencing services unless otherwise agreed in writing.
Packages and memberships are non‑transferable without prior written consent.
Failure to make payment by the due date may result in suspension or termination of services.
2. Cooling‑Off Period
A mandatory seven (7) day cooling‑off period applies to all new memberships or service agreements as required by the WA Fitness Industry Code of Practice.
You may cancel in writing within this period. A reasonable administration fee and any used services may be deducted.
3. Session Bookings, Cancellations & Lateness
In‑person PT sessions require a minimum of 24 hours’ notice for cancellation or rescheduling.
Cancellations within 24 hours or no‑shows will result in the session being forfeited and non‑refundable.
Sessions finish at the scheduled time regardless of client arrival. Arrival more than 15 minutes late may count as a missed session.
Trainer may cancel or reschedule sessions due to illness, gym closure, or unforeseen events; clients will be offered an alternate session or credit.
4. 8‑Week Challenge & Online Coaching
8‑Week Challenge fees are non‑refundable once the program has commenced.
Online coaching clients must provide one (1) month’s written notice to cancel ongoing services. Access remains until the end of that notice period; no refunds for current billing cycles.
5. Health & Safety
All exercise and nutrition guidance is for general fitness information and not medical advice.
Clients must disclose all relevant health conditions, injuries, or medications before training.
Clients should consult a medical professional before beginning any new fitness or nutrition program.
If you experience pain, dizziness, or discomfort during training, stop immediately and inform the trainer.
6. Liability & Insurance
Participation in exercise carries inherent risks. You accept full responsibility for any injury or loss arising from participation, except where caused by our negligence under law.
Infinite Performance maintains professional indemnity and public liability insurance.
Clients are advised to obtain their own health or injury insurance if desired.
7. Privacy & Data Protection
All personal information is handled in accordance with the Privacy Act 1988 (Cth) and relevant WA laws.
Information will not be shared without your consent except as required by law.
8. Amendments
Infinite Performance reserves the right to update or amend these Terms & Conditions. Changes will be communicated via email or online notice.
9. Acknowledgment
By signing up for or participating in any Infinite Performance service, you acknowledge and accept these Terms & Conditions in full.
You accept the inherent risks of exercise and understand that training guidance does not replace professional medical advice.
